Welcome to Wibhoo. By accessing or using our website, mobile applications, or any associated services (collectively, the “Platform”), you agree to be bound by these Terms of Service. The Platform is owned and operated by Wibhoo (“Company”, “we”, “us”, or “our”). If you do not agree to these terms, please do not use the Platform.

1. THE NATURE OF WIBHOO MARKETPLACE

Wibhoo is an online marketplace connecting conscious consumers with independent local brands, merchants, and artisans who specialise in sustainable goods, services, and community experiences (each a “Vendor”).

  • You acknowledge and agree that Wibhoo is a platform provider and does not sell or manufacture the products nor host the vendor events directly.
  • The commercial contract for the sale of any product or service on the Platform is strictly a bipartite agreement directly between you (the Buyer) and the independent Vendor. Wibhoo is not a party to that transaction and assumes no liability arising out of or in connection with it.

2. ACCOUNT REGISTRATION & SECURITY

To place orders or register for events, you may be required to create a user account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the confidentiality of your account credentials.
  • Accept responsibility for all activities that occur under your account.
  • We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. USER CONDUCT & ACCEPTABLE USE

You agree not to use the Platform to:

  • Violate any local, national, or international laws or regulations.
  • Circumvent the platform’s checkout system to purchase items directly from vendors off-platform.
  • Post false, misleading, defamatory, or harmful content, reviews, or comments.
  • Attempt to reverse-engineer, scrape, or compromise the digital security of the Platform.

4. INTELLECTUAL PROPERTY

All content on the Platform, including text, graphics, logos, button icons, software, and images, is the property of Wibhoo, its Vendors, or its content suppliers and is protected by international copyright, trademark, and database right laws. You may not extract or utilise parts of the content of the Platform without our express written consent.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Wibhoo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of, or inability to access or use, the Platform.
  • The quality, safety, sustainability, legality, or delivery of products or experiences listed by independent vendors.
  • Any unauthorised access to or use of our secure servers and/or any personal information stored therein.

6. GOVERNING LAW AND JURISDICTION

These terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts. 

Privacy Policy

At Wibhoo, we respect your privacy and are committed to protecting your personal data. This Privacy Policy outlines how we collect, use, disclose, and safeguard your information when you interact with our Platform.

1. INFORMATION WE COLLECT

We collect several types of information from and about users of our platform, including:

  • Identity and Contact Data: Name, email address, delivery/billing address, phone number, and account username.
  • Transaction Data: Details about payments to and from you and other details of products and services you have purchased from vendors through our platform.
  • Technical and Usage Data: IP address, browser type, operating system, pages visited, and interaction data collected through cookies and tracking tools.

2. HOW WE SHARE YOUR INFORMATION (MARKPLACE EXCLUSION)

Because Wibhoo is a multi-vendor marketplace, we must share certain segments of your personal data with the independent third-party vendors you purchase from to facilitate order processing, shipping, and customer support.

  • Vendors receive only the strictly necessary information required to fulfil your order (e.g., your name, shipping address, and telephone number for courier coordination).
  • Vendors are contractually prohibited from using your personal data for unsolicited marketing purposes outside the scope of the specific transaction, unless you provide independent, explicit consent to them.

3. THIRD-PARTY PAYMENT AGENTS & PROCESSING

We do not store your full credit/debit card numbers or UPI PINs on our servers. All financial transactions are processed securely through accredited third-party payment gateways. These processors adhere to the Payment Card Industry Data Security Standard (PCI-DSS).

4. DATA RETENTION AND YOUR RIGHTS

We retain your personal data only as long as necessary to fulfil the purposes for which it was collected, including legal, accounting, or statutory reporting requirements. Depending on your location, you may have rights to access, correct, delete, or limit the processing of your personal data. SHIPPING & DELIVERY

Thank you for shopping mindfully. Wibhoo works alongside decentralised, eco-conscious brands across the country to provide unique items while managing eco-friendly supply lines.

1. MULTI-VENDOR SPLIT SHIPPING

Because Wibhoo is a marketplace composed of decentralised, independent sustainable creators:

  • Items ordered in a single transaction may be dispatched from entirely different locations by different vendors.
  • Consequently, your order may arrive in multiple separate packages over a staggered period.
  • You will receive distinct tracking numbers for each shipment as soon as the respective vendor hands the package over to their delivery partner.

2. SHIPPING TIMELINES

  • Processing: Independent vendors generally pack and dispatch items within 2 to 4 business days of order confirmation. Handmade, upcycled, or made-to-order bespoke items may require additional processing time, which will always be explicitly highlighted on the specific product detail page.
  • Transit: Standard domestic delivery typically takes between 3 and 7 business days following dispatch, depending on the destination region.
  • Delays: While we track fulfilment rigorously, Wibhoo is not directly responsible for shipping delays caused by unexpected courier logistics anomalies, extreme weather events, or regional operational difficulties faced by third-party delivery partners.

 

CANCELLATION

1. No Order Cancellation

Once an order is placed on Wibhoo, it cannot be cancelled.

Please review your order carefully before confirming the purchase, including the product details, quantity, delivery address, and other order information.

2. No Refunds

Wibhoo does not provide refunds for cancelled or placed orders.

3. Replacement Only

If a product is eligible for replacement under the respective vendor’s terms and conditions, a replacement may be offered.

Replacement is subject to:

  • the vendor’s replacement policy,
  • product condition requirements,
  • proof of issue such as photos or videos, where applicable, and
  • approval by the vendor and Wibhoo.

4. Vendor-Specific Terms

Certain products may be non-replaceable based on the vendor’s category, product nature, hygiene standards, customization, or other stated conditions.

REFUND, RETURN & EXCHANGE

Wibhoo’s return and replacement approach is designed to support small-scale local artisans, reduce unnecessary reverse logistics, and limit the carbon impact of transport-heavy e-commerce. At the same time, we aim to keep the policy practical, fair, and aligned with the applicable vendor terms and consumer law requirements.

1. General Policy

Wibhoo does not offer refunds for standard change-of-mind requests.

Orders are generally final once placed. Customers are expected to review product details, size, materials, images, descriptions, and vendor conditions carefully before placing an order.

2. Replacement Eligibility

A replacement request may be considered only if:

  • the item is received in a damaged condition,
  • the item is defective,
  • the wrong item is delivered, or
  • the item materially differs from the product description displayed on Wibhoo.

Replacement requests are subject to the respective vendor’s terms and conditions, product category rules, and verification of the issue reported.

3. Request Window

Customers must raise a replacement request within 48 hours of delivery.

Requests made after this period may not be accepted, unless the vendor policy or applicable law requires otherwise.

4. Condition of the Product

To be eligible for a replacement review, the item must:

  • be unused,
  • be unwashed and unaltered,
  • be in its original packaging,
  • include original tags, invoices, manuals, and accessories, where applicable,
  • be supported by clear proof such as unboxing video or photographs, where required.

5. Non-Returnable and Non-Exchangeable Categories

To reduce avoidable reverse logistics and respect health, hygiene, and product-specific restrictions, the following categories are generally not eligible for return or exchange, except where the item is damaged, defective, or incorrect on delivery:

  • personal care, cosmetics, and hygiene products,
  • intimate apparel, underwear, and swimwear,
  • perishable grocery items, fresh produce, spices, and snacks,
  • customised, engraved, or made-to-order items,
  • clearance or marked-down final sale items.

Category-specific exceptions may apply only if stated by the vendor or required under applicable law.

6. Shipping Costs for Approved Claims

If a replacement request is approved for a damaged, defective, or incorrect item:

  • the vendor will bear the return shipping cost, or
  • the vendor may arrange pickup, where feasible.

If a customer request is outside the eligible replacement criteria, any reverse shipping cost, if accepted at all, will be borne by the customer and will be communicated before processing.

7. Vendor Discretion and Final Decision

All replacement approvals are subject to:

  • vendor verification,
  • inspection of the submitted evidence,
  • product condition at the time of review,
  • stock availability for the same or equivalent replacement item,
  • and Wibhoo’s final review where needed.

If the same item is unavailable, the vendor may offer a suitable replacement option, if permitted under vendor terms.

8. Misuse of Policy

Wibhoo reserves the right to reject claims that appear fraudulent, repeated without valid grounds, or inconsistent with the product condition or supporting evidence provided.

9. Policy Priority

In the event of any conflict between this policy and a vendor-specific product policy, applicable consumer law, or category-specific rule, the stricter or legally required rule will apply.
